Terms of Service

Canberra AI Phone Agents

 

Effective Date: 03 March 2025

 

These Terms of Service (“Terms”) govern your use of services provided by Canberra AI Phone Agents (“we,” “us,” or “our”), including the design, deployment, and maintenance of AI-powered phone agents. By engaging our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms.

 

1. Service Overview

Canberra AI Phone Agents provides small businesses with custom-designed, AI-powered inbound phone agents. These agents are configured based on the specific needs and workflows of your business.

 

2. Subscription & Payment Terms

 

2.1 Minimum Term Commitment

All service plans require a minimum commitment of three (3) monthly payments. Early termination before the end of the initial 3-month term will result in the remaining balance of the commitment becoming immediately payable.

 

2.2 Billing & Renewal

Plans are billed monthly in advance. After the initial 3-month term, services will continue on a month-to-month basis until cancelled with at least 14 days’ written notice before the next billing cycle.

 

2.3 Payment Method

You agree to provide a valid payment method and authorize Canberra AI Phone Agents to charge applicable fees on a recurring basis unless cancelled in accordance with these Terms.

 

3. Client Responsibilities

 

3.1 Input & Collaboration

The success of your AI agent depends on your active participation. You agree to provide all necessary information, access to systems (e.g., calendars, booking platforms), and cooperation required to configure and maintain the AI agent.

 

3.2 Timely Feedback

You must provide timely feedback and approvals throughout the design and implementation process. Delays in providing such feedback may impact project timelines and delivery.

 

4. Ownership & Intellectual Property

All intellectual property developed by Canberra AI Phone Agents, including conversation scripts, agent logic, and proprietary systems, remain the property of Canberra AI Phone Agents. Clients are granted a non-exclusive, revocable license to use the AI agent for the duration of their subscription.

 

5. Service Availability & Support

We aim to provide a high level of uptime and agent reliability. However, service interruptions may occur. Canberra AI Phone Agents is not liable for losses or damages resulting from downtime, third-party platform failures, or system outages.

 

6. Termination & Suspension

We may suspend or terminate your service if:

  • You fail to make payment within 7 days of the due date.

  • You breach any of the obligations outlined in these Terms.

  • You engage in behavior that negatively impacts our platform or reputation.

You may terminate your subscription after the initial 3-month term with written notice as described in Section 2.2.

 

7. Limitation of Liability

To the maximum extent permitted by law, Canberra AI Phone Agents shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, business interruption, or data loss arising out of the use or inability to use our services.

 

8. Privacy & Data Handling

We take data privacy seriously. Your data and your customers’ data will be handled securely and in accordance with applicable privacy laws. You are responsible for complying with all laws regarding customer communications in your jurisdiction.

 

9. Amendments

We reserve the right to modify these Terms at any time. Continued use of our services after such modifications constitutes your acceptance of the updated Terms. We will provide notice of any material changes.

 

10. Governing Law

These Terms are governed by the laws of the Australian Capital Territory (ACT). Any disputes arising out of these Terms will be subject to the exclusive jurisdiction of the courts of the ACT.

 

By using our services, you acknowledge that you have read, understood, and agreed to these Terms.
